What is procedure for obtaining a building permit for the erection of a residential dwelling deck?


Submit a site location plan which has been developed from a plot plan by a licensed land surveyor.

Site location plan shall indicate setbacks of proposed construction to property lines as per Zoning Ordinance requirements for the district in which the project is located.

Applicant shall obtain variance(s) from the Zoning Ordinance for any deviation related thereto. Application for said variances are made through the Planning & Zoning office.

Submit an application to the Architectural Review Board for any proposed construction which is visible from a public street and after any variances from the Zoning Board of Appeals are obtained. The following shall be included with said application:

  • Appropriate fee in check form payable to the Village of Tarrytown based on the estimated market value of the work proposed. The Board meets the second Tuesday of each month and applications shall be received three (3) weeks prior to the meeting.
  • Scaled drawings (three (3) sets) of proposed work which reflects what the appearance (plan elevation) of the proposed deck will be including materials and colors being used. Said drawing shall also include three (3) site location plans.

Upon approval of any Zoning variances and after ARB approval where applicable, submit Building Permit application with three (3) sets of construction grade scaled plans by a New York State licensed architect or engineer which reflects compliance with the State Uniform Fire Prevention and Building Code. Any exemption to this requirement may be granted by the Building Inspector upon submission of complete scaled construction plans that fulfill all code requirements for projects with less than $10,000 value.

All applications shall include the following:

  • Indicate the estimated market value of the proposed work where requested on the application form and pay related fee in check form payable to the Village of Tarrytown.
  • Submit general contractors "Certificate of Insurance" for Workmen's Compensation with the Village named as "Certificate Holder".
  • Submit copy of a current Westchester County Home
  • Improvement License for the general contractor.

Plan review is then performed by the Building Department which reviews all applications on the basis of first come, first served.

All comments developed from said review are forwarded to the project engineer/architect or owner where appropriate for revision and/or resolution.

Revised plans are resubmitted and again reviewed by the Building Department for compliance with previous comments.

Plans are reviewed on the basis of first come first served.
