GENERAL REQUIREMENTS TO PERFORM WORK IN A VILLAGE STREET OR RIGHT-OF-WAY

The following duties and obligations are imposed upon each person receiving a permit under the provisions of this article:

1. A completed permit application to include the names, addresses and (EMERGENCY) telephone numbers of property owner and all contractors associated with the project.

2. Contractor's insurance certificate for general liability and workmen's compensation (NYS form C-105.2, see https://www.wcb.ny.gov/content/onlineforms/obtainC105.jsp ) made out to the village of Tarrytown with “Village of Tarrytown as additionally insured.”

3. The applicant for this permit is responsible for the temporary repair of the public right-of-way prior to final restoration as approved by the village engineer, superintendent of public works or their designee. Temporary repair is to consist of two (2) inches of asphalt concrete placed on top of k-krete backfill and level with the existing road service.

4. All excavations shall be by open cut, unless by special permission of the village engineer superintendent of public works or their designee.

5. All trenches shall be backfilled using k-krete 50 in the traveled way or under sidewalks; trenches outside the traveled way may be backfilled with gravel or item 4 compacted in layers no greater than 12 inches, providing a 95% compaction.

6. All work done under any permit issued hereunder, whether directly by the applicant or by others, to whom the work is sublet, shall conform to the requirements of the village engineer, superintendent of public works or their designee and shall be under full supervision of the applicant, who shall be solely responsible for the character of the work done.

7. All excavations shall not remain open and must be protected when the site is unattended.

8. Temporary trenches shall be widened a minimum of one (1) foot beyond the original cut or any crack developed from the adjacent pavement setting as a result of the excavation. The base course of road pavement shall consist of NYSDOT type 1a asphaltic concrete to a depth equal to the existing base course, but not less than 4 inches top / finish course shall consist of NYSDOT type 7f of 2 ½ inches, placed in 2 lifts. The edges of the trench shall receive a liberal application of asphaltic emulsion to seal all edges.

9. The person to whom this permit is issued shall maintain sufficient guards, barricades, lights or watchpersons to protect persons and property against injury and damage by reason of any such opening(s).

10. All roadway openings which require steel plates shall have the plates recessed into the pavement and properly pinned and ramped with asphalt to secure against movement and any noise disturbances.

11. A sketch or plans fully describing the project and showing limits of work incorporating village specifications and details pertinent to the scope of work.

12. Should any work be performed in the roadway where traffic is obstructed or parking meters are blocked, a maintenance and protection of traffic plan in accordance with the manual of uniform traffic control devices (MUTCD) is required. Police control of traffic may be necessary at the discretion of the Tarrytown police chief. There is a fee for occupying parking meter spaces.

13.Roads recently paved (within 3 years) are subject to curb to curb resurfacing along with trench restoration.

14. Inspections: (minimum required for acceptance of the work)

• Pre-work, Open trench, Backfill, Forming of the work, Pavement restoration, Final restoration

15. Dumpsters shall be equipped with flashing lights attached thereto or must have barricades with flashing lights. Dumpsters shall be located in an area where visibility for both vehicular and pedestrian traffic is not obstructed. Dumpsters shall not be located in crosswalks, curves, at the crest of a hill or where there exists limited site distance. Dumpsters shall be removed immediately when full. Dumpster may be replaced as required for the duration of the work under conditions of the permit. Dumpsters that occupy parking spaces with meters shall pay a fee for utilizing a metered parking space.

Applicant hereby states that he/she has read the provisions of Chapter §259 of the Code of the Village of Tarrytown along with these general requirements and acknowledges that these provisions become conditions upon which approval is granted to perform work in Village of Tarrytown streets and/or right-of-way. Applicant further acknowledges the duties and obligations imposed on the permittee, and as precedent condition to receiving this permit, applicant agrees to fully and faithfully perform and discharge each and every one of such duties and obligations.
