POLICIES AND PROCEDURES OF THE PLANNING BOARD
PLANNING BOARD MEETINGS
The Planning Board (the “Board”) meetings are as follows unless otherwise specified or noticed by the Board:
§ Fourth Monday of each month – regular working meeting, at which time a review of applications will occur. Review of site-specific applications and environmental issues will be discussed at these meetings.
§ Special meetings may be scheduled from time to time. These meetings are subject specific. These meetings will be noticed on the Village’s scroll and website.
§ In the event a regularly scheduled meeting of the Planning Board falls on a holiday, the regular meeting will be held the following day.
§ On the Monday prior to the meeting, the Planning Board agenda will be finalized. Applications will be scheduled on the agenda in order of submission.
§ Meetings begin at 7:00 p.m.
SUBMISSIONS
The Tarrytown Village Code, specifically Chapters 263 (Subdivison of Land) and 305 (Zoning), outline the information/documentation that is required to be sumitted by an applicant. All required application information must be submitted to the Planning and Zoning Office at least twenty-one (21) calendar days prior to the next regularly scheduled meeting. Twelve (12) complete assembled sets of an application must be submitted for distribution. All drawings must be folded by the applicant and be part of the assembled packet. Modified submittal information must be received by the Planning and Zoning Office at least eithteen (18) calendar days prior to the next regularly scheduled meeting.
New applications will be placed on the agenda for Board determination of completeness. When the Board determines the materials submitted are sufficient to move an application forward, a public hearing will be schedule.
NOTICE OF PUBLIC HEARING - 305-45 OF THE TARRYTOWN VILLAGE CODE
All applicants, at least ten (10) days prior to the public hearing, shall send written notice by certified mail, return receipt requested, to all owners within 100 ft. of the affected property and to any other such persons as the applicable Board may deem necessary, all at the expense of the applicant. Property owners entitled to notice shall be those listed as owners on the record in the Village of Tarrytown Tax Assessor’s Office as of the date of mailing. The written notice shall contain information equal to the notice published in the newspaper, and proof of mailing receipts must be furnished
prior to the public hearing. Any person making an application is further required to erect a sign facing each public street on which the property abuts, giving notice that such application has been made and that a public hearing will be held. Such signs shall be obtained from the Building Inspector. Signs are to be displayed for a period of not less than ten days immediately preceding the hearing date or any adjourned hearing date. The sign shall not be set back more than ten feet from any property or street line and shall not be less that 2 ft. or more than 6 ft. above the grade at the property line. Said sign shall be affixed to a suitable frame, which will assure visibility from the street at all times. At the
commencement of the public hearing, the applicant is required to file an affidavit, which states that the aforementioned public notice requirements have been complied with.
What is the Policy & Procedure of the Planning Board re: Escrow Accounts?
ESCROW ACCOUNTS - 305-58B OF THE TARRYTOWN VILLAGE CODE
At the time of submission of any application before the Planning Board, the Planning Board may require the establishment of an escrow account from which withdrawals shall be made to reimburse the village for the cost of professional review services. The applicant shall then provide funds to the village for deposit into such account in the amount to be determined by the Planning Board based on its evaluation of the nature and complexity of the application. The applicant shall be provided with copies of any village voucher for such services as they are submitted to the village. When the balance in such escrow account is reduced to ½ of its initial amount, the applicant shall deposit additional funds into such account to bring its balance up to the amount of the initial deposit. If such account is
not replenished within 30 days after the applicant is notified, in writing, of the requirement for such additional deposit, the Planning Board may suspend its review of the application. A building permit or certificate of occupancy shall not be issued unless all professional fees charged in connection with the applicant’s project have been reimbursed to the village. After all pertinent charges have been paid, the village shall refund to the applicant any funds remaining on deposit.
What is the Policy & Procedure of the Planning Board re: Recreation Fees?
RECREATION FEES - 305-58E OF THE TARRYTOWN VILLAGE CODE
All development subject to site plan review and approval pursuant to 305-52 through 305-61 may be conditioned upon the payment of a recreation fee contribution to a Village Recreation Fund which may be established by the Board of Trustees pursuant to New York State Village Law 7-725-a, Subdivision 6(a), (b), (c) and (d).
All fees and fee structures shall be defined and established by resolution of the Board of Trustees.
The fee to be placed in a recreation fund shall be $7,000 per lot or per unit, whichever is greater, with annual cost-of-living adjustments based on the CPI as of January 1 of each calendar year.
1. Submission of a site development plan to the Planning Board for their review and approval (including public hearing):
A. Application is made through the Village Clerk's office and site plans are developed showing items/procedure outlined by Section 305-54 & 61 of the Zoning Ordinance. (Copies obtained through Village Clerk's office as part of application form).
B. Village consultants (site engineering and landscaping) are requested to review and comment on proposals.
C. Review of requirements for Environmental Review Act compliance is performed.
2. Zoning Board of Appeals application for variance (if needed) are done normally after Planning Board approval. (Unless otherwise directed by the Planning Board). Applications for variances are made through the Village Clerk's office.
3. Upon approval of the Planning Board and obtaining any necessary ZBA variance, application to the Architectural Review Board is made with at least scaled elevations including materials and colors proposed (three (3) sets of drawings) if project is visible from any public street. Said application shall include related fee based on market value of work proposed and be made in check form payable to the Village of Tarrytown. This Board meets the second Tuesday of the month and applications must be received three (3) weeks prior to meeting.
4. Submit construction grade drawings and specifications by a licensed architect and/or engineer which reflects compliance with the State Uniform Fire Prevention and Building Code as well as other applicable local Ordinances (Sprinkler Law, Plumbing Code, etc.) after approvals required by item #1 thru item #3 above are obtained. Application shall include the following:
A. Indicate the fair market cost of the proposed work where requested on application form and pay related fee in check form payable to the Village of Tarrytown.
B. Submit general contractors "Certificate of Insurance" for Workmen's Compensation" with the Village named as "Certificate Holder".
C. Submit site drainage and grading plans as approved by Village Engineer and including erosion control methods proposed.
D. Show compliance with local requirements for sprinkler system.
E. Submit site landscaping plan approved by Village Landscaping Consultant.
5. Plan review is then performed by the Building Department which reviews all applications on the basis of first come, first served.
A. If site plan approval of construction plans by Village Engineer has not previously been done, plans are forwarded for his review and comment.
B. Plans are forwarded to Village Structural Consultant for his review and comment.
C. Obtain Village Landscaping Consultants review and comments as per Planning Board approval.
D. All comments developed from reviews are forwarded to project architect or engineer for revision and/or resolution.
E. Develop cost estimate for site work and landscaping. Obtain Village Consultants approval of said estimate and pay related 6% inspection fee.
F. Pay Village recreation fee.
Revised plans are resubmitted and again reviewed by the Building Department and appropriate consultants for compliance with previous comments. Plans are reviewed on the basis of first come, first served. When compliance with appropriate code and standards is shown, Building Permit is issued.
