What is the Policy & Procedure of the Planning Board re: Recreation Fees?


All development subject to site plan review and approval pursuant to 305-52 through 305-61 may be conditioned upon the payment of a recreation fee contribution to a Village Recreation Fund which may be established by the Board of Trustees pursuant to New York State Village Law 7-725-a, Subdivision 6(a), (b), (c) and (d).

All fees and fee structures shall be defined and established by resolution of the Board of Trustees.

The fee to be placed in a recreation fund shall be $7,000 per lot or per unit, whichever is greater, with annual cost-of-living adjustments based on the CPI as of January 1 of each calendar year.

  1. Submission of a site development plan to the Planning Board for their review and approval (including public hearing):
    1. Application is made through the Village Clerk's office and site plans are developed showing items/procedure outlined by Section 305-54 & 61 of the Zoning Ordinance. (Copies obtained through Village Clerk's office as part of application form).
    2. Village consultants (site engineering and landscaping) are requested to review and comment on proposals.
    3. Review of requirements for Environmental Review Act compliance is performed.
  2. Zoning Board of Appeals application for variance (if needed) are done normally after Planning Board approval. (Unless otherwise directed by the Planning Board). Applications for variances are made through the Village Clerk's office.
  3. Upon approval of the Planning Board and obtaining any necessary ZBA variance, application to the Architectural Review Board is made with at least scaled elevations including materials and colors proposed (three (3) sets of drawings) if project is visible from any public street. Said application shall include related fee based on market value of work proposed and be made in check form payable to the Village of Tarrytown. This Board meets the second Tuesday of the month and applications must be received three (3) weeks prior to meeting.
  4. Submit construction grade drawings and specifications by a licensed architect and/or engineer which reflects compliance with the State Uniform Fire Prevention and Building Code as well as other applicable local Ordinances (Sprinkler Law, Plumbing Code, etc.) after approvals required by item #1 thru item #3 above are obtained. Application shall include the following:
    1. Indicate the fair market cost of the proposed work where requested on application form and pay related fee in check form payable to the Village of Tarrytown.
    2. Submit general contractors "Certificate of Insurance" for Workmen's Compensation" with the Village named as "Certificate Holder".
    3. Submit site drainage and grading plans as approved by Village Engineer and including erosion control methods proposed.
    4. Show compliance with local requirements for sprinkler system.
    5. Submit site landscaping plan approved by Village Landscaping Consultant.
  5. Plan review is then performed by the Building Department which reviews all applications on the basis of first come, first served.
    1. If site plan approval of construction plans by Village Engineer has not previously been done, plans are forwarded for his review and comment.
    2. Plans are forwarded to Village Structural Consultant for his review and comment.
    3. Obtain Village Landscaping Consultants review and comments as per Planning Board approval.
    4. All comments developed from reviews are forwarded to project architect or engineer for revision and/or resolution.
    5. Develop cost estimate for site work and landscaping. Obtain Village Consultants approval of said estimate and pay related 6% inspection fee.
    6. Pay Village recreation fee.

Revised plans are resubmitted and again reviewed by the Building Department and appropriate consultants for compliance with previous comments. Plans are reviewed on the basis of first come, first served. When compliance with appropriate code and standards is shown, Building Permit is issued.
